SALES POLICIES AND CONDITIONS OF SALE OF SYBARTUM 1988 S.L.

 

1) The buyer customer undertakes to carry out the following measurements prior to their purchase:

1. a) Having previously measured that the furniture or object enters the room of the home, office, business or establishment for which it was purchased.
2. b) Having previously measured that the furniture or object enters through the door of their home, office, business or establishment, whatever it's a balcony or window, roof, etc., or where it has been planned to enter it and also have all the respective permits.
3. c) Having previously measured that the furniture or object enters through the access doors that lead to their home, office, business or establishment, whatever it's an apartment, house, building, etc. and have all the respective permissions to do so.
4. d) Having previously measured that the furniture or object enters the elevator if it is going to be entered by it. In case not, if it needs to be entered by stairs, had true measured all passes, turns and that can circulate freely through floors, corridors and stairs and have all the respective permits to do so.

 

2) The buyer customer is fully aware that Sybartum 1988 S.L. is not responsible, does not cancel the purchase, does not return the money or assume any responsibility of any nature if the buyer customer did not make the relevant measurements, forgot to do them or did them wrong prior to the purchase or if did not obtain the corresponding permits to enter the furniture or object of their purchase in their home, office, business or any establishment. Likewise, the buyer customer accepts that they will bear all the expenses that they incur or may incur, for cutting, disassembling or modifying the furniture or objects so that they can have access to their home, office, business or establishment. Likewise, it acknowledges and accepts that the costs of hiring personnel and/or carpenters to carry out these modifications to the furniture or objects of their purchase must be borne by them.

3) Any separate or additional expense that the buyer customer has to incur to introduce the furniture or object to their home, office, business or establishment is also fully borne by the buyer customer (and accepts it). For example, the rental of tools, the rental of cranes, lifters, trucks, platforms, elevators and machinery in general, as well as their operators, personnel and all the permitting costs to do so.

4) The cost of freight or transport of the furniture or any other merchandise or object is not included in the sale price. Freight and transportation expenses must be agreed and paid separately by the buyer customer whether they are made by Sybartum 1988 S.L. or with the company chosen for this purpose.

 

5) Unless specifically specified in writing by Sybartum 1988 S.L., freight or transport is understood to be only transport from the premises and/or deposits of Sybartum 1988 S.L. to the sidewalk or street of the buyer customer where the transport vehicle can arrive and is allowed to do so. It does not imply loading or transferring the furniture or objects to the interior of the home, office, business or establishment, nor carrying them or carrying them through elevators, corridors, stairs, walkways, etc. Freight is understood as transport to street level. As far as the transport vehicle can reach or access freely and without obstacles and is, in turn, allowed to do so.

6) When the freight or transport is outsourced and carried out by another company other than Sybartum 1988 S.L., any subsequent liability of Sybartum 1988 S.L. ceases, from the moment the physical delivery of the furniture or objects is made to the chosen transport company.

7) The buyer customer when making the purchase knows, understands and accepts (and thus manifests it) that all the furniture of Sybartum 1988 S.L. are made with rustic, natural woods, with little or no industrial processing, recycled, recovered, rebuilt woods, subjected to inclement weather and the elements, even woods rescued from oceans, seas and rivers that have been adrift for years.

That they are made in a traditional and rustic way, with an endless number of what in other types of furniture could be considered "defects", but in this type of furniture these details or "defects" rather enhance them, since precisely in them its beauty lies in the fact that each one is unique in its style and nature. Its beauty makes life in imperfection and not in perfection. The buyer customer therefore knows, understands and accepts (and thus manifests it) that all the furniture or objects of Sybartum 1988 S.L. show imperfections and irregularities in general: marks, holes, cracks, separations, wear, breaks, areas subjected to inclement weather, perforations left by insects, exposed support wood, screws, pins, nuts, nails and metals in general rusted and exposed, imbalance in the compositions, stains, cracks, unevenness, discoloration, burned areas, friction when opening drawers and doors, kinks, unevenness, uneven finishes, imbalances in the legs and a long list of other matters. The buyer customer declares and accepts that understands this and states that has checked all these details before making the purchase and where unequivocally assumes the nature of them and that is fully satisfied with it. For this same reason, none of all these imperfections will be valid for the return or cancellation of the purchase later. The buyer customer also understands, accepts and thus expresses it when making the purchase, that the wood and/or furniture or objects will continue to move, cracking, compressing, expanding, dilating or collecting well beyond its purchase or very later to its purchase, when furniture and/or wood are exposed to changes in temperature at different times of the year or climates or air-conditioned environments inside the home, office, business or establishments. It is the very nature of wood when it is processed in an artisanal way and not processed in an industrial way as when the process of drying the wood is carried out naturally and not with industrial ovens.

That is why each piece of furniture will continue in time and for years its slow process of defining its character until finally finding itself, to express it in a metaphorical way. And this is precisely what is sought and where lies the beautiful intrinsic philosophy behind this style of wood and rustic and handmade furniture.

By buying and accepting the sale that is made, the buyer customer declares to have previously read the Sales Policies and Conditions of Sale of Sybartum 1988 S.L. set forth herein and to agree with each and every one of them.
